1. About This Document

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.


This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE. Please read the Terms of Use carefully before proceeding.

2. Platform & Owner

The Platform is owned by Maxto Private Limited, a company incorporated under the Companies Act, 1956, with its registered office at Talikoti, Karnataka, India (hereinafter referred to as ‘Platform Owner’, ‘we’, ‘us’, ‘our’).


The Platform includes the website at maxtoapp.azurewebsites.net, including related mobile site and mobile applications.


For the purpose of these Terms of Use, wherever the context so requires, ‘you’, ‘your’ or ‘user’ shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

3. Use of Platform

Your Obligations

The use of the Platform and/or availing of our Services is subject to the following:

  1. You agree to provide true, accurate, and complete information during and after registration, and you shall be responsible for all acts done through the use of your registered account.
  2. Your use of our Services and the Platform is solely and entirely at your own risk and discretion. You are required to independently assess and ensure that the Services meet your requirements.
  3. You agree to pay us the charges associated with availing the Services.
  4. You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or Indian or local laws that might apply to you.
  5. You understand that upon initiating a transaction for availing the Services, you are entering into a legally binding and enforceable contract with the Platform Owner.
  6. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms and/or applicable laws.
  7. The Platform may contain links to third-party websites. On accessing these links, you will be governed by the terms and policies of those third-party websites.
These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

4. Intellectual Property

The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents include and are not limited to the design, layout, look, and graphics.


You must not:

  • Republish material from this Platform
  • Sell, rent, or sub-license material from this Platform
  • Reproduce, duplicate, or copy material from this Platform
  • Redistribute content from this Platform

5. Liability & Warranty

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this website or through the Services for any specific purpose.


You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

6. Indemnification

You shall indemnify and hold harmless Maxto Private Limited, its affiliates, group companies (as applicable), and their respective officers, directors, agents, and employees from any claim, demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of:

  • Your breach of these Terms of Use, Privacy Policy, and other Policies
  • Your violation of any law, rules, or regulations
  • Your infringement of the rights (including intellectual property rights) of a third party

7. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event, including but not limited to acts of God, natural disasters, war, government actions, or other events beyond reasonable control.

8. Governing Law & Disputes

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.


All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Karnataka, India.

Refund & Cancellation

This policy outlines how you can cancel or seek a refund for a product or service purchased through the maxtoapp Platform. Please read carefully before placing an order.

Cancellation Policy

Cancellation Window

Cancellations will only be considered if the request is made within 7 days of placing the order.


However, cancellation requests may not be entertained if:

  • The orders have been communicated to the seller/merchant and they have initiated the process of shipping
  • The product is already out for delivery

In such an event, you may choose to reject the product at the doorstep.

Perishable Items

Maxto Private Limited does not accept cancellation requests for perishable items like flowers, eatables, etc.


However, a refund or replacement can be made if the user establishes that the quality of the product delivered is not good.

Damaged or Defective Items

Reporting Damaged Goods

In case of receipt of damaged or defective items, please report to our customer service team within 7 days of receipt of the product.


The request will be entertained once the seller/merchant listed on the Platform has checked and determined the issue at their own end.

Product Not As Described

In case you feel that the product received is not as shown on the site or as per your expectations, you must bring it to the notice of our customer service within 7 days of receiving the product.


The customer service team, after looking into your complaint, will take an appropriate decision.

Warranty Products

In case of complaints regarding products that come with a warranty from the manufacturers, please refer the issue to them directly.

Refund Timeline

In case of any refunds approved by Maxto Private Limited, it will take 6 days for the refund to be processed back to you through the original payment method.

Refund Method

Approved refunds will be processed to the original payment source (bank account, UPI, credit/debit card) used at the time of purchase. Maxto Private Limited does not issue cash refunds.

Shipping Policy

Shipping & Delivery

Shipping Method

Orders for the user are shipped through registered domestic courier companies and/or speed post only.

Dispatch Time

Orders are shipped within 1 day from the date of the order and/or payment, or as per the delivery date agreed at the time of order confirmation — subject to courier company/post office norms.

Delivery Address

Delivery of all orders will be made to the address provided by the buyer at the time of purchase. Please ensure your delivery address is accurate and complete before confirming your order.


Delivery of our services will be confirmed on your email ID as specified at the time of registration.

Shipping Costs

If there are any shipping costs levied by the seller or the Platform Owner, the same is not refundable.

Delivery Delays: Platform Owner shall not be liable for any delay in delivery by the courier company or postal authority. Delays due to courier logistics, weather, or other external factors are outside our control.

Return Policy

We offer refund/exchange within the first 7 days from the date of your purchase. If 7 days have passed since your purchase, you will not be offered a return, exchange, or refund of any kind.

Eligibility for Return

Conditions for Return/Exchange

In order to become eligible for a return or an exchange, all of the following must apply:

  • The purchased item should be unused and in the same condition as you received it
  • The item must have original packaging
  • Items purchased on sale may not be eligible for return/exchange

Only such items are replaced by us (based on an exchange request) if such items are found defective or damaged.

Exempted Categories

There may be a certain category of products/items that are exempted from returns or refunds. Such categories of products will be identified to you at the time of purchase.

Return Process

Inspection & Approval

For accepted exchange/return requests, once your returned product/item is received and inspected by us, we will send you an email to notify you about receipt of the returned/exchanged product.


If the same has been approved after quality check at our end, your request (i.e. return/exchange) will be processed in accordance with our policies.

Returns or exchanges that do not meet the eligibility criteria above will be rejected and the item will be returned to you. Shipping costs for rejected returns are borne by the customer.
